Here is the current language of proposed Constitutional amendment prohibiting physical desecration of the U.S. flag:
The Congress shall have power to prohibit the physical desecration of the flag of the United States.
Seems straightforward, doesn't it? Except for all kinds of potential legal loopholes. This country is based on the ideal of freedom of expression – even expression we do not like. Enshrining it as an untouchable icon would undermine the message of the American flag. You know, kind of like false gods. Protect free speech, not just cloth.
And what should we make of what George W. Bush is doing?
